Kieren Fallon has this morning been banned from taking the ride on the Aidan O’Brien trained runner Recital in the 2011 Investec Derby this afternoon after the connections of Native Khan were successful in winning their appeal over a breach of contract.

In a morning of high drama it was ruled that Fallon had indeed breached his contract that he had with Native Khans owner Ibrahim Araci after he decided that he would partner Recital instead of Native Khan in the premier classic.

Speaking this morning Mr Araci’s lawyer expressed delight in this client’s successful appeal “It was a breach of contract and my client is very happy with the judgement. He believes in the Derby and the British judgement system and knows they’re bigger than Kieren Fallon.”

A statement from Fallon’s QC said “He’s very disappointed but he wishes the connections of Native Khan, Recital and Pat Smullen the best of luck in the race and will be watching closely from the changing room.”

Irish champion jockey Pat Smullen will now take the plum ride on Recital in the Derby which goes to post at 4.00pm.
